Why CBI didnt arrest Pappu so far,asks SC

New Delhi: In what could embarrass the government,the Supreme Court has asked why the agency has not arrested former RJD MP Pappu Yadav for three months despite clear directions. Dismissing Yadav's pleas for review of the May 3 order cancelling his bail and exemption from surrendering in the case relating to the murder of CPM leader Ajit Sarkar,a Bench comprising Justices Markandey Katju and A K Patnaik said: "We are surprised to note that despite cancellation of bail of the accused by this court,neither the accused has surrendered nor he has been taken into custody."

It's a norm under the criminal justice system that the prosecuting agency,in this case CBI,takes the accused into custody immediately after a court cancels his bail. In the Pappu Yadav case,the Bench said: "By an order dated May 3,2010,we had set aside the Patna High Court judgment (granting him bail) dated February 18,2009.It was directed that petitioner-accused Rajesh Ranjan alias Pappu Yadav be taken into custody forthwith."

The present order came on Thursday when the Bench dismissed a petition filed by Yadav seeking review of the May 3 order of the apex court.He had.in the alternative,sought exemption from surrendering.A Bihar CBI court had on February 14,2008,convicted Yadav for plotting the murder of Sarkar in June 1998.Yadav had appealed against the conviction in the Patna High Court,which during the pendency of the appeal had granted him bail in 2009.The SC has expressed its anguish over the CBI not taking Yadav into custody for last three months.
